The National Center for Personal Data Protection reminds
Taking photos and videos by citizens without the consent of patients, visitors, medical workers, and other persons in healthcare organizations is prohibited!
Consent may be verbal and must be obtained before starting the recording from all individuals appearing in the camera lens.
The absence of consent is a violation of Part 2 of Article 18 of the Law “On Information, Information Technology, and Security of Information” and entails liability under Article 23.7 of the Code of Administrative Offenses.
What to do if you were “recorded” without permission?
- Contact the author of the photo and video recording with a request to delete the recording or fragments containing your image.
- Report the violation to the officials of the healthcare organization and the administration of the platform where the video or photo is hosted.
- If your demands were ignored, contact the National Center for Personal Data Protection or the internal affairs authorities to hold the guilty person administratively liable.
